In a court appearance that has stirred emotions in the East Rand of Gauteng, a 12-year-old boy faced charges of culpable homicide and driving without a licence at the Brakpan Magistrate’s Court on Monday. This shocking incident, which unfolded over the weekend, resulted in the untimely death of a 14-year-old, who was struck by a vehicle allegedly driven by the young accused.

The boy, accompanied by his guardian, was met with a mix of disbelief and sympathy as he entered the courtroom, reflecting the tragic weight of the situation. Lumka Mahanjana, spokesperson for the National Prosecuting Authority, confirmed that the minor was initially taken to the Brakpan charge office. He was subsequently released into the care of his parents by the police on 08 June 2025. This decision aligns with the legal considerations regarding the treatment of minors within the judicial system.

The magistrate has opted to postpone the case until 28 August 2025, focusing on determining the boy’s criminal capacity, a complex issue given his age. The South African legal framework stipulates specific procedures when it comes to minors facing serious allegations, aiming to strike a balance between accountability and the understanding that children face unique circumstances in their development.

This incident highlights the ongoing conversations around road safety and the implications of young drivers.
