The Madlanga Commission of Inquiry is set to issue former Investigating Directorate Against Corruption (IDAC) head Advocate Andrea Johnson with a Rule 3 notice after fresh allegations emerged during the commission’s proceedings.
The notice will afford Johnson an opportunity to respond to evidence that may adversely affect her before the commission reaches any findings.
The development comes just a day after Johnson concluded nearly a week of testimony before the inquiry.
The commission’s decision follows the emergence of new allegations contained in a statement submitted by State Advocate Drushantha Ramsamy, who is currently giving evidence.
Evidence leader Advocate Lee Segeels-Ncube told the commission the allegations first surfaced while Johnson was testifying on 22 July about aspects of the Mokwele investigation.
He said he received a message from a Directorate for Priority Crime Investigation (DPCI) officer indicating that Ramsamy had made disclosures relating to the matter and wished to consult with the National Prosecuting Authority (NPA).
Segeels-Ncube said he immediately excused himself from the proceedings to engage with the NPA, and a consultation with Ramsamy was arranged while Johnson was still giving evidence.
He added that the commission first became aware of the allegations during Johnson’s testimony and that Ramsamy had indicated she wanted to give her evidence in public.
The issuing of a Rule 3 notice means Johnson could be recalled to respond to the fresh allegations before the commission completes its work.
The latest development comes after Johnson faced days of intense questioning over several high-profile investigations undertaken during her tenure as head of IDAC.
