General Shadrack Sibiya appeared in the Randburg Magistrates’ Court on charges of rape and sexual assault, with the State opposing his release on bail.
The 59-year-old South African Police Service lieutenant general was arrested on Monday and faces allegations involving the rape of an 18-year-old woman and the sexual grooming of a 16-year-old girl.
Sibiya is expected to remain in custody and will be transferred to Kgosi Mampuru II Correctional Centre. He is due to return to court on 29 September.
During the proceedings, prosecutors told the court that there had allegedly been attempts to interfere with State witnesses and assist the accused in evading arrest.
The State also alleged that a voice note was sent to one of its witnesses on Tuesday, while serious threats had allegedly been made against witnesses and alleged victims.
Prosecutors further alleged that a group described by the State as a “cabal” was working with the accused. They said these developments had complicated the investigation and raised concerns about the safety of witnesses and alleged victims.
The State is seeking Sibiya’s transfer to Kgosi Mampuru II Correctional Centre, citing concerns about the risk of escape and the safety of those involved in the case.
The defence is opposing the proposed transfer, arguing that no adequate explanation has been provided and questioning whether the matter falls within the jurisdiction of the Pretoria court.
The State has also informed the court that not all electronic devices linked to the investigation have been recovered. Prosecutors allege that some devices were concealed by the accused on the instructions of his legal team.
A media contingent gathered outside the courtroom as the National Prosecuting Authority and the defence discussed whether journalists would be permitted to film and record the proceedings.
The case is expected to return to court on 29 September, when further proceedings will take place.
