Footballer Mokete Sean Mogaila has been convicted of culpable homicide and failing to render assistance after a crash in Tembisa killed a nine-year-old girl and seriously injured her mother and teenage brother.

Mogaila, 29, pleaded guilty to all three charges when he appeared in the Tembisa Magistrates’ Court.

The charges stem from a collision on Andrew Mapheto Road in the early hours of 30 October 2024.

According to the National Prosecuting Authority (NPA), Mogaila admitted that the vehicle he was driving veered into oncoming traffic and crashed into a vehicle carrying Gomolemo Mavimbela, her mother and her 13-year-old brother.

Gomolemo died in the collision.

Her mother and brother survived but suffered serious injuries.

The NPA said Mogaila fled the crash scene before later handing himself over to law enforcement authorities on the same day.

During the investigation, police found alcohol bottles and drugs inside his vehicle, the NPA said.

Mogaila entered his guilty plea in terms of Section 112(2) of the Criminal Procedure Act, admitting the elements of the offences and accepting the State’s version of events.

The court subsequently convicted him on all three charges.

He will return to court on 17 November 2026 for sentencing.

The NPA welcomed the conviction, saying Mogaila’s guilty plea spared Gomolemo’s family the emotional strain of a lengthy trial.

“The conviction represents an important step towards justice for the deceased child and her family,” the NPA said.

The prosecution authority said it remained committed to holding accountable people whose unlawful and reckless conduct results in death or serious injury.

Mogaila remains before the court pending sentencing.
