Former deputy national police commissioner Shadrack Sibiya will remain in custody after the Randburg Magistrates’ Court postponed judgment on his bail application to Tuesday, 20 October.
Sibiya appeared in court on Thursday, where Magistrate Hlengiwe Mkhabisi said she needed more time to consider the extensive documentation submitted during the proceedings.
“I’m not going to be in a position to deliver my judgment today. I can’t even do it tomorrow, unfortunately,” Mkhabisi told the court.
The magistrate confirmed that judgment would be delivered on Tuesday at 8am.
Sibiya’s bail application has been heard since September, with the state and defence presenting arguments over whether he should be released pending the outcome of his case.
His legal team asked the court to grant him bail of R20,000, while the state opposed his release, arguing that he could flee South Africa if granted bail.
Sibiya is accused of raping an 18-year-old woman and sexually grooming a minor. He has pleaded not guilty to all the charges against him.
He will remain in custody until the court delivers its judgment on his bail application.
