The Judge presiding in murder case of Senzo Meyiwa, Justice Ratha Mokgoatlheng said “competent police” would have taken the clothes worn by the people who were in the house when Senzo Meyiwa was shot and killed.
Mokgoatlheng’s remakes came after the 7th state witness, Tumelo Madlala finished giving testimony where he revealed that he doesn’t remember police officers doing a gun residue test on him as part of the investigation into Meyiwa’s killing.
“I am only going to ask one question about our police. You have already said they have not taken any residue test on you. What they will do there is a liquid which they will smear on your hands. Did they do that,” asked Mokgoatlheng.
Madlala said: “I don’t remember my Lord.”
“The other thing is competent police should have taken all your clothes. I am surprised because this firearm exploded in a confined space. Common sense tells you that they should have taken all the clothes of all the people who were there and conduct the same test on that. They didn’t do that?” asked Mokgoatlheng again to which Madlala responded in the negative.
During his cross examination Madlala remained adamant that there were intruders in the house the night the soccer star was killed at Vosloorus in 2014.
Muzikawukhulelwa Sibiya, Bongani Sandiso Ntanzi, Mthobisi Prince Mncube, Mthokoziseni Maphisa and Sifisokuhle Nkani Ntuli are charged with murder, attempted murder, robbery with aggravating circumstances, unlawful possession of firearms and ammunition.
The five men on trial have pleaded not guilty to all the charges.
