IDAC reviews Magistrate’s recusal in Lt-Gen Dumisani Khumalo’s case

The National Prosecuting Authority (NPA)’s Investigative Directorate Against Corruption (IDAC), has taken the matter relating to the recusal of the presiding Magistrate in the case involving SAPS Intelligence Head, Lieutenant-General Dumisani Khumalo at the Pretoria High Court under review. 

Magistrate Vusimuzi Mahlangu recused himself from the controversial case on Tuesday, citing allegations of corruption and fraud levelled against him at the Madlanga Commission of Inquiry in Pretoria. 

IDAC spokesperson Henry Mamothame is adamant that the move was unnecessary especially in the matter involving Khumalo and two co-accused matters. 

“The IDAC is of the view that the magistrate should not have recused himself from the matter, as allegations made at the commission have no bearing on the matter before court,” said Mamothame.  

Mahlangu’s decision was announced on Wednesday in what was supposed to be Khumalo, Major-General Josias Lekalakala and Major-General Nosipho’s application to have their bail conditions relaxed. 

The trio was arrested with four others on charges of fraud and corruption for the alleged improper appointment of an unqualified official within the Crime Intelligence Division. 

The new developments led to the postponement of the case to the 6th of November 2025. 

IDAC adds that the matter will resume after the outcome of its review application.

Meanwhile, the Madlanga Commission is expected to resume on Thursday, after it was adjourned on Tuesday.

This after the Commission Chairperson, Justice Mbuyiseli Madlanga, raised safety concerns about the safety of ‘Witness X’ who was giving his evidence remotely through an intermediary.
