The Minister of Justice and Correctional Services Ronald Lamola has signed off extradition request for of Siyabonga Ndimande and Malusi Ndimande from the Kingdom of Eswatini to South Africa.
The siblings are wanted in South Africa for their alleged involvement in murder of rapper Kiernan “AKA” Forbes and his friend Tebello “Tibz” Motsoane.
The two were killed during an attack outside a Durban restaurant in February last year.
“The Ministry of Justice and Correctional Services confirms that Minister Ronald Lamola has approved and transmitted a request by South Africa for the extradition of Siyabonga Gezani Ndimande and Malusi Dave Ndimande from the Kingdom of Eswatini to the Republic of South Africa.
The request is made in terms of the Extradition Treaty between South Africa and Eswatini dated 4 October 1968, and in terms of the SADC Protocol on Extradition dated 3 October 2002, to which both countries are signatories,” said Lamola’s spokesperson, Chrispin Phiri.
Phiri added that the Ministry is ready to give its highest level of co-operation to its counterparts in the Kingdom of Eswatini.
The siblings were arrested earlier this month following a request by South Africa’s law enforcement authorities, after they allegedly fled to the Kingdom of Eswatini to evade arrest in the AKA and Tibz murders.
According to the National Prosecuting Authority (NPA) the two are also wanted for several crimes in and around Durban.
Their case has been stalled at the Manzini Magistrates Court, as the prosecuting authority in that country was waiting for a formal extradition request from South Africa.
Meanwhile, the bail application of five other suspects arrested in connection with the killings, is continuing at the Durban Magistrates Court.
Lindani Zenzele Ndimande, Mziwethemba Harvey Gwabeni, Lindokuhle Ndimande, Lindokuhle Thabani Mkhwanazi and Siyanda Eddie Myeza, are facing charges of conspiracy to commit murder, murder, unlawful possession of a firearm, unlawful possession of ammunition, five counts of attempted murder and money laundering.
