The repeat offender and convicted rapist, Amos Khumalo was sentenced to life imprisonment for rape and eight years for attempted rape of two minors at a Pretoria Hotel in 2020. The 47-year-old was initially charged with two counts of rape and kidnapping. The court has convicted him of rape of the 13-year-old and attempted rape of the 11-year-old.
It emerged in court during the judgment that Khumalo raped the first victim and then moved on to second victim but couldn’t penetrate her. The Magistrate said Khumalo showed no remorse for the crimes committed. “His guilty plea was motivated by the fact the evidence was overwhelming against him such as DNA results linking him to the offence.
“Moreover, it is disquieting to this court to know that the probation officer told court that the accused tried to exonerate himself by maligning the victim as being the ones who insisted on going out with him for a night. While on the other hand he said he was reluctant,” said the magistrate.
The court found that Khumalo had planned the crimes. “As I have indicated he had to identify a hotel of choice of how many rooms to book. He chose one room where he was going to spend the night with the children.
“This would have involved some processes. The processes include and are not limited to making payments for his stay at the hotel. Processes which would have come upon him to apply his mind.
“He even stated that after booking he left the room and went to buy drinks at a nearby filling station,” said the magistrate.
The magistrate said his state of intoxication even though it is a relevant factor doesn’t in this instance retract the worthiness of the offence . Khumalo was previously sentenced to seven years imprisonment for assault with intent to do grievous bodily harm in 2007.
He was again sentenced to seven years for rape and released on parole. The family of the victims welcomed the judgement saying the life sentence is what they were hoping for.
