The Special Investigating Unit (SIU) said it had no choice but to approach the courts to force the JB Marks Local Municipality in Potchefstroom, North West, to hand over important documents sought in its investigations.
The unit is investigating allegations of maladministration in connection with the construction of a flood line canal next to the N12 provincial road in Ikageng extension 11.
According to the unit, the municipality failed to cooperate after several attempts to access the required documentation.
The SIU said it was granted a search and seizure warrant by the Potchefstroom Magistrates Court on Thursday morning to search the municipal offices and seize the evidence that may assist in the ongoing investigation.
“Lack of cooperation prompted the SIU to seek the court’s assistance in securing a warrant to search and seize pertinent documents and electronic equipment.
“The seized materials include Company registration documents, payment records, laptops, mobile devices, and external storage media used by relevant officials and employees.
“Any associated electronic data, including emails and cloud storage information linked to specific personnel,” said SIU spokesperson Kaizer Kganyago.
The SIU highlighted that it is empowered by the Special Tribunals Act to subpoena bank statements and cell phone records, search and seize evidence, and interrogate witnesses under oath to thoroughly investigate allegations brought before it.
Kganyago added that SIU will refer any evidence pointing to criminal conduct it uncovers to the National Prosecuting Authority for further action.
