Supreme Court of Appeal dismisses Dr Nandipha Magudumana’s unlawful arrest bid

The Supreme Court of Appeal has ruled against Dr Nandipha Magudumana's claim of unlawful arrest in a decisive judgment that may have far-reaching implications for her ongoing case and that of her accomplice in a notorious escape saga.

The Supreme Court of Appeal (SCA) has dismissed Dr Nandipha Magudumana’s attempt to have her arrest declared unlawful, solidifying the authority of South African legal proceedings in a highly publicised case involving allegations of escape and complicity in crime. Magudumana, who is accused number one in the controversial escape of convicted rapist and murderer Thabo Bester, challenged the Free State High Court’s previous decision that upheld her deportation from Tanzania.

Magudumana’s petition to the SCA argued that her deportation constituted a disguised extradition. She asserted that she had not consented to her return to South Africa; however, the court ruled otherwise. The National Prosecuting Authority (NPA) has expressed strong approval of the SCA’s decision, with spokesperson Mthunzi Mhaga stating, “We welcome the dismissal of the deportation appeal, it vindicates our long-held view firmly that the deportation of Dr Magudumana from Tanzania in 2023 was above board.”

The NPA further clarified that Magudumana was neither arrested nor forced into submission during her deportation, claiming she was escorted in a manner that conformed with legal protocol and without any unnecessary restraints.

Magudumana is currently detained at the Bizzah Makgathe Correctional Centre. Her involvement in Bester’s prison escape in May 2022 has attracted immense media scrutiny. Both she and Bester were brought back to South Africa in April 2023, following an international manhunt that placed their lives under intense public examination.

The court’s decision is a pivotal moment not only for Magudumana’s legal battle but also for the ongoing case against Bester, who was sentenced to life imprisonment. Given the complexity of extradition and arrest laws, the SCA’s ruling ensures that legal channels are maintained, providing a foundation for subsequent judicial processes.

As discussions continue about the implications of this ruling, the possibility of an appeal to the Constitutional Court looms. The NPA has stated its readiness to defend its position should Magudumana decide to pursue this path, noting they “will vigorously and meticulously argue for the same application to be dismissed with costs.” The outcome of this latest legal maneuver remains to be seen, as the narrative surrounding this case develops further.
