The cross-examination of the Vodacom forensic liaison supervisor Pinky Vythilingam is expected to continue in the Senzo Meyiwa murder trial at the North Gauteng High Court in Pretoria.

Yesterday, defence counsel Charles Mnisi said the cellphone evidence that a retired cellphone analyst supplied last year did not correspond with Vythilingam’s current data. The defence the accused the state of fraud after discrepancies regarding data evidence came to light.

The information in question today is the alleged communication between singer and Meyiwa’s girlfriend at the time of his death, Kelly Khumalo, and one of the accused, Fisokuhle Ntuli, before the murder of the Bafana Bafana captain took place.

During yesterday’s proceedings Advocate Mnisi also threatened to open a case of fraud against those responsible for compiling the cellphone data evidence which did not correspond.

Mnisi said: “On the basis of this information, we need to approach our instructing attorneys with a view to go lay a formal case or formal complaint against the compilers of information on behalf of our accused.”

Judge Ratha Mokgoatlheng said: “I thought you will lay charges of fraud?”

Advocate Mnisi: “That complaint will be premised on fraud, altering and defeating the ends of justice. Because this information is misleading the court.”
