Judgment in the ANC MP Sibusiso Kula’s bail application postponed

ANC Member of Parliament Sibusiso Kula will know his fate in a week’s time after approaching the North West High Court in Mahikeng seeking to overturn a decision of the Orkney Magistrate Court which denied him bail.

Kula was arrested in January and charged with the murder of his wife Jennifer Kula, whose lifeless body was found lying in a pool of blood in their home by Kula last November.

On Thursday Kula’s  attorney together with the State prosecutor made their submission before the court on why Kula should be granted bail or not.

The National Prosecuting Authority’s North West spokesperson Henry Mamothame was confident that Kula would not be released and said it would be in the best interest of justice for Kula to stand trial while behind bars.

“The state urged strongly against this application (for bail). His appeal has also not shifted our focus on completing investigations in preparations for trial.

“Advocate Benny Kalakgosi argued strongly for the State in persuading the court not to grant Kula bail. Judge Andre Petersen will apply his mind and consider all arguments and supporting documents presented in court before passing judgment,” Mamothame said. 

Police said Kula’s wife was found murdered on November 27, in what seemed like a robbery. She was found with a stab wound on her back but the object that was used for her alleged murder has not been recovered.

The matter was reported by the medical facility where Kula allegedly transported her to receive medical attention.  

Further information before the court stated that Kula told the police that he was not present at his home when the incident occurred.

Kula is expected back in the Orkney Magistrates Court on April 17 after his case was postponed to allow police to conduct further investigations.
