The state in the case against controversial businessman Brown Mogotsi has requested a postponement to allow time to verify his residential address.
This emerged during Mogotsi’s brief appearance at the Johannesburg Magistrate’s Court on Monday morning, where he faces charges linked to allegedly staging his own assassination attempt in Vosloorus last November.
State prosecutor Thami Mpekana told the court that the postponement was necessary due to delays in the submission of Mogotsi’s address.
“I have consulted with the investigating officer. If this address was given earlier, I do not think there was going to be any problem,” said Mpekana.
He added that the state would not oppose Mogotsi’s bail application, provided the address is successfully verified.
“The reason being, it will depend on the address. If the address is verified, there is no problem in regard to the address. It must also be noted that this is a Schedule 5 matter. Then the state will not be opposing, but it is for the court to decide the issue of bail,” he said.
Mogotsi is facing charges of unlawful possession of a firearm, unlawful possession of ammunition, discharging a firearm in a built-up area, defeating the ends of justice, and perjury.
According to the state, on 3 November 2025, Mogotsi reported to police that while driving alone in Vosloorus, he was pursued by occupants of a bakkie who allegedly fired multiple shots at his vehicle, forcing him to stop and flee on foot.
Police subsequently launched an attempted murder investigation. However, investigations later allegedly revealed that Mogotsi deliberately stopped his vehicle, exited while armed with a firearm, and fired multiple shots at his own vehicle.
It is further alleged that Mogotsi made a false statement under oath in an affidavit deposed before a commissioner of oaths, claiming that unknown assailants had shot at his vehicle.
Mogotsi is expected to return to court on 25 May.
