The Molopo Magistrates court in Mahikeng in the North West will on Friday deliver judgment in the bail application of murder accused and insurance fraudster, Agnes Setshwantsho.
This is after both the defence and state delivered their closing arguments on Monday, following testimony by the investigating officer, Sergeant Kheshi Mabunda, and the Correctional Department nurse from the facility where the accused is detained.
The 49-year-old Setshwantsho has been in custody since her arrest in November last year for alleged fraud, defeating the ends of justice and murder of her niece Bonolo Modiseemang in March 2023.
According to the state, the suspect killed 30-year-old Modiseemang to benefit from a R3 million life insurance claim she took on her behalf.
The state delivered its closing arguments on Monday where it opposed Setshwantsho’s release on bail.
The NPA wants the accused to remain in custody until the matter is completed as it believes that it is in the best interest of justice to do so, and that she can evade trial.
Setshwantso’s legal representative Nhlanhla Mahlangu, argued in court that state witness Mabunda, who is also the investigating officer, failed to prove that his client was a flight risk.
Previously, the court heard that the accused is a key suspect in the inexplicable deaths of about four of her relatives.
During his testimony, Mabunda told the court that he had applied to exhume the remains of Seshwantsho’s husband who was a police officer, her son and two daughters.
The accused has been remanded in police custody pending the outcome of her bail application.
