The Pretoria Magistrates’ Court has granted former head of the Investigating Directorate Against Corruption (IDAC) at the National Prosecuting Authority (NPA), Andrea Johnson, and former South African Police Service (SAPS) Deputy Head of Crime Intelligence, Feroz Khan, bail of R10,000 each.
The two were arrested on Friday morning and face charges of assault with intent to cause grievous bodily harm, with Johnson accused of being an accessory after the fact, as well as defeating the ends of justice.
Johnson is also facing a charge of contravening the National Prosecuting Authority Act 23 of 1998.
According to the NPA, on 26 June 2018, Khan was involved in a physical confrontation with his junior colleague, a female SAPS Crime Intelligence employee, Brigadier Phethle.
Khan allegedly attacked the victim with a pen, stabbing her, before also striking her with his hands and a paper file. The incident reportedly left the victim with injuries to her face and chest.
Phethle reported the incident to the police in June 2018.
“However, it is alleged that Khan submitted a warning statement to the investigating officer on 5 July 2018, before the case docket was submitted to the NPA for guidance and a decision.
“This prompted an investigation into how Khan was able to submit the warning statement before the NPA received the docket.
“Investigations revealed that Johnson, without the permission of the National Director of Public Prosecutions, allegedly disclosed information to Khan, and that both acted with a common purpose to hinder his prosecution,” said NPA spokesperson Kaizer Kganyago.
Kganyago said Johnson and Khan were arrested following investigations by the Commission’s Recommendations Task Team (CRTT).
He added that the State did not oppose their release on bail because they were not considered flight risks and their residential addresses had been verified.
“Both were granted bail of R10,000 each, on condition that Johnson surrenders her passport to the investigating officer by 4 November 2026.
“The matter was postponed to 2 February 2027 for further investigations,” added Kganyago.
