The subpoena requiring suspended Crime Intelligence deputy head Major-General Feroz Khan to appear before the Madlanga Commission of Inquiry remains in effect, despite reports that he has been readmitted to hospital.
Commission spokesperson Jeremy Michaels said Khan’s legal team had informed the commission that they may seek a postponement of his testimony, which is scheduled for 1 September.
However, Michaels said the commission had not received a formal postponement application as of Monday.
“From what we understand, he was released from hospital several weeks ago. And under those circumstances, then, his subpoena stands to appear before the Commission tomorrow,” Michaels said.
Khan was previously hospitalised after being shot and seriously wounded in Houghton in June. He spent weeks receiving treatment for injuries sustained in the shooting.
Reports now indicate that the senior police officer has been readmitted to a Johannesburg hospital, just days before he is due to appear before the inquiry.
The commission is yet to determine whether Khan will be able to attend or whether his legal team will formally request that his testimony be postponed.
Khan’s appearance is being closely watched, as the commission has already heard allegations concerning his conduct and role within Crime Intelligence. His testimony would give him an opportunity to respond directly to evidence and allegations placed before the inquiry.
The developments come as the Madlanga Commission continues its investigation into alleged corruption, criminality and political interference within South Africa’s policing and criminal justice structures.
For now, Khan’s subpoena remains valid, with any decision to postpone his appearance dependent on a formal application and the commission’s consideration of the circumstances surrounding his reported hospitalisation.
