Suspended deputy national police commissioner Shadrack Sibiya has claimed that the 16-year-old girl he is accused of sexually grooming had a crush on him. He also claims that his alleged sexual encounter with the 18-year-old woman he is charged with raping was consensual.

Sibiya launched his bail application in the Randburg Magistrate’s Court on Tuesday, where he indicated that he intends to plead not guilty to all the charges against him.

Sibiya claims that the father of the 16-year-old girl, referred to in his affidavit as Mr M, was the person who introduced him to the teenager. He further claims that Mr M sent him a video of the girl masturbating before telling him that she had a crush on him.

“Mr M and his sister held a braai at Kempton Park to which I was invited.

“Mr M requested me to pick up his daughter, ZM, from Centurion. For this purpose, he gave me her phone number and details.

“I did pick up ZM as requested. I also picked up a second passenger and her daughter at around 2pm. We proceeded to the braai at Kempton Park,” Sibiya said in his affidavit, describing how he claims he was introduced to the teenager by her father.

Sibiya said that approximately a week after the braai, Mr M visited his home.

“On this occasion, he was disturbed and told me he had received a video of ZM masturbating from an undisclosed source. He forwarded this offending video to me while expressing his disappointment.

“Mr M told me, in the same breath, that ZM had a crush on me and proceeded to phone her in my presence. Mr M then confronted ZM telephonically with this fact, and she confirmed that she indeed had a crush on me,” he said.

Sibiya said he subsequently met Mr M and “the ladies” at a Pretoria hotel on two occasions.

He claims that he had sexual intercourse with the 18-year-old woman during their second meeting and maintains that the encounter was entirely consensual.

Sibiya then called a witness, a lawyer attached to the law firm representing him.

The bail application was postponed to Thursday at the State’s request.

Sibiya has not pleaded to the charges, and the allegations against him have not been proven in court.
