Mpumalanga taxi owner Joe “Ferrari” Sibanyoni and his three co-accused are expected back in the Delmas Magistrates Court on Tuesday as their extortion and money-laundering case continues.

The State alleges that the accused extorted more than R2.2 million from a businessman.

Tuesday’s proceedings are expected to focus on the disclosure of the State’s docket to the defence, following the collapse and subsequent re-enrolment of the case earlier this year.

Sibanyoni and his co-accused were each granted R70,000 bail when the matter was re-enrolled in May.

The case has been marked by a series of legal challenges and disputes over its handling.

The matter was previously struck off the roll at the KwaMhlanga Magistrates Court by former Chief Magistrate Tuletu Tonjeni.

Tonjeni also found prosecutor Mkhuseli Ntabo in contempt of court and authorised a warrant for his arrest.

The National Prosecuting Authority (NPA) subsequently lodged a complaint with the Magistrates Commission over Tonjeni’s handling of the case.

The commission appointed an independent investigator and subpoenaed witnesses as part of its review of the complaint.

Meanwhile, Sibanyoni and fellow taxi owner Bafana Sindane have approached the Mbombela High Court in an effort to stop the NPA from re-enrolling the case.

Despite the pending legal challenge, the prosecution has continued, with the matter now before the Delmas Magistrates Court.
