The legal representative of alleged political fixer Brown Mogotsi says the defence team will return to court with a renewed bail application based on new facts, following his brief appearance at the Johannesburg Magistrate’s Court today.

Mogotsi remains in custody after his initial bail application was denied. The court previously ruled that he had failed to provide satisfactory proof of a permanent residential address — a key requirement in assessing whether an accused person can be released on bail, as courts must be satisfied that an accused is properly traceable and unlikely to evade trial.

He is facing serious allegations, including claims that he staged his own assassination attempt in Vosloorus in November.

Mogotsi’s lawyer, Makau Sekgatja, said the defence is now seeking to clarify the disputed issue of residence in an effort to strengthen a renewed bid for bail.

“If you can remember during the bail judgment, the issue was the address,” Sekgatja told the court. “The magistrate indicated during her reasoning she was not satisfied with the address. So the new facts are in relation to clarifying this particular address.”

He added that Mogotsi is frustrated by his continued detention while awaiting the next stage of proceedings.

“I can agree that he is very frustrated, he believes that he is entitled to his bail,” Sekgatja said, adding that he had limited time to consult with his client.

The matter has been postponed to 22 June, when the defence is expected to formally bring a fresh bail application based on the new information.
